This Privacy Policy applies to personal information collected through the Website and the current early-access application.
The Website is presently an informational and early-access-interest website. Blue Seagull is not currently selling or providing commercial services through the Website.
If you later participate in a pilot, early-access program, or commercial service governed by a separate agreement or notice, additional privacy terms may apply to that separate relationship.
2.1 Information you provide directly
When you submit an early-access application, we collect the information you enter into the form, currently including:
- Name
- Email address
- Organisation / organization
- Description of your workflow
- Software used
- Team size
- Anything else you choose to provide in the optional free-text field
Depending on what you choose to write, some of this information may describe your professional role, work environment, institution, business, or technical workflow.
We do not ask you to provide sensitive personal information through the application. Please do not submit confidential project data, client-restricted information, credentials, financial information, health information, government identifiers, export-controlled information, or other sensitive or legally restricted information.
2.2 Technical information generated by hosting infrastructure
The Website is hosted using Amazon Web Services (AWS), including AWS Amplify.
AWS Amplify generates and stores access logs relating to requests made to hosted applications. These logs may include technical request information such as an IP address, date and time of a request, request details, and technical information associated with the request.
We do not use this technical information for behavioral advertising or cross-site tracking.
Blue Seagull currently does not use:
- analytics cookies;
- advertising cookies;
- behavioral-tracking technologies;
- advertising pixels;
- cross-site tracking; or
- targeted-advertising technologies
on the Website.
We also do not currently use third-party analytics products such as Google Analytics, Meta Pixel, LinkedIn Insight Tag, or Microsoft Clarity.
Our hosting infrastructure may nevertheless process ordinary server and access-log information necessary to deliver, operate, protect, and troubleshoot the Website. Server-side access logging is not used by Blue Seagull for behavioral advertising.
If we introduce cookies, analytics, advertising technologies, or materially different tracking practices in the future, we will update this Privacy Policy and implement any notice or consent mechanism required by applicable law before using them.
We use information submitted through the early-access application to:
- receive and manage your expression of interest;
- review and evaluate your early-access application;
- understand whether your stated workflow, software use, team size, organization, or use case may be relevant to a future testing, pilot, or early-access opportunity;
- maintain the early-access applicant list;
- contact you, if we choose to do so, regarding your application or a related future product-testing, pilot, or early-access opportunity;
- respond to privacy, legal, security, or support-related requests concerning the Website; and
- protect the Website and our systems against fraud, abuse, unauthorized access, and security incidents.
We do not use early-access application information to send unrelated newsletters or general marketing communications.
If we want to use personal information for a materially different purpose that requires additional notice or consent, we will provide the required notice or obtain the required consent before doing so.
Submitting an application does not mean that you are subscribing to a newsletter or general marketing list.
Blue Seagull may contact you only in connection with:
- your early-access application;
- your potential participation in product testing;
- a possible pilot; or
- a possible early-access opportunity related to your application.
Submitting an application does not guarantee that we will contact you.
6.1 We do not sell applicant personal information
Blue Seagull does not sell or rent personal information submitted through the early-access application.
We do not disclose applicant personal information to third parties for their independent advertising or marketing purposes.
We do not use applicant personal information for targeted advertising.
6.2 Service providers acting on our behalf
We use Amazon Web Services (AWS) to host the Website and supporting infrastructure and to process or store information on our behalf.
AWS acts as an infrastructure/service provider in connection with our use of AWS services. Information processed by AWS on our behalf is not provided to AWS for AWS's independent marketing or advertising use.
6.3 Legal requirements and protection
We may disclose information if we are required to do so by applicable law, regulation, legal process, or a valid governmental or judicial request, or when disclosure is reasonably necessary to protect the rights, security, or integrity of Blue Seagull, the Website, or other persons, to the extent permitted by law.
Blue Seagull Group Corp. is a United States corporation and uses AWS infrastructure.
If you submit an application from outside the United States, your personal information may be processed or stored outside your country of residence in connection with Blue Seagull's operations and the AWS infrastructure used by Blue Seagull.
Where applicable law imposes requirements on international processing or transfers, we will handle personal information in accordance with those requirements.
8.1 Early-access application data
We intend to retain personal information submitted through an early-access application for up to two (2) years from the date of submission, unless:
- you request deletion earlier and we are legally permitted to comply;
- the information is no longer reasonably necessary for the purposes described in this Policy and is deleted earlier; or
- a longer retention period is required or permitted by applicable law in connection with a legal, security, or compliance obligation.
If an applicant later enters into a separate pilot, testing, early-access, or commercial agreement with Blue Seagull, information governed by that separate relationship may be subject to a different retention period disclosed at that time.
8.2 Hosting and access logs
AWS Amplify separately generates hosting access logs as part of the infrastructure used to operate the Website. Those infrastructure logs are subject to AWS service operation and retention practices and may not follow the same two-year schedule as the early-access application database.
Blue Seagull does not use those logs for targeted advertising or cross-site behavioral tracking.
Depending on where you live and which law applies, you may have rights concerning your personal information.
Regardless of location, you may contact us to request that we:
- provide information about personal data we hold about you;
- correct inaccurate application information;
- delete your early-access application and associated personal information, subject to lawful exceptions;
- stop using your information for the early-access application where applicable;
- limit certain uses or disclosures; or
- explain our response to a privacy request.
To submit a request, email:
Use a subject line such as "Privacy Request" and describe what you are requesting.
We may ask for information reasonably necessary to verify your identity before acting on a request. We will use verification information only as permitted for handling the request.
If applicable law gives you a right to appeal our response to a privacy request, you may email sheva@blueseagull.org with the subject line "Privacy Appeal" and explain why you believe the decision should be reconsidered.
If Mexican data-protection law applies to your personal information, you may exercise the rights of:
- Access — request access to personal data concerning you and information about its processing;
- Rectification — request correction of inaccurate, incomplete, or outdated information;
- Cancellation — request cancellation of personal data when legally appropriate; and
- Opposition — object to processing in circumstances recognized by applicable law.
You may also request to limit the use or disclosure of your personal information or revoke consent where applicable.
To make any of these requests, email sheva@blueseagull.org. Your request should identify you, provide a means for us to respond, describe the information concerned, and clearly state the right or action you want to exercise. We may request reasonable documentation or information necessary to verify your identity or authority to act for another person.
Revocation of consent does not have retroactive effect and may be subject to circumstances in which continued processing is permitted or required by law.
Because Blue Seagull does not currently use the Website to track users over time across third-party websites for behavioral advertising, we do not currently change the Website's behavior in response to browser Do Not Track signals.
We do not knowingly permit third-party advertising companies to collect personally identifiable information through the Website over time and across unrelated websites for targeted advertising on our behalf.
We use administrative, technical, and organizational measures intended to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.
No internet transmission, hosted system, or database can be guaranteed to be completely secure. You should therefore avoid submitting information that the early-access application does not request, particularly confidential, sensitive, or legally restricted information.
The early-access application is intended only for persons who are 18 years of age or older.
We do not knowingly solicit or accept early-access applications from individuals under 18. If we learn that an individual under 18 submitted personal information through the application, we may delete the information.
If you believe a person under 18 has submitted personal information to us, contact sheva@blueseagull.org.
We may update this Privacy Policy as our Website, data practices, or legal obligations change.
When we make changes, we will post the revised Policy on the Website and update its effective date.
If a change materially affects how we use personal information already collected and applicable law requires additional notice or consent, we will provide that notice or obtain that consent as required.
